Getting a PPO in Wayne County... PPOs are misunderstood frequently and are considered more of a right than a legal tool to quell violence or the eminent apprehension of violence. We have a sense of "justice" that we believe the court will uphold given the right argument. Well folks, that's just not true. In law school they'll tell you, "If you want Justice - die, if you want to get F*ed - go to court..." That's effectively factual. Think about it... You want a PPO because an acquaintance decided they hate you - calls you fowl names and threaten to kick your ass. So I represent you in PPO court. The case before ours, a young woman of color gets regularly beaten and r***d by her estranged ex. She has a cut on her forehead and a black eye. The judge grants her petition... We go up next, "You're honor, my client has an acquaintance that hates him, calls him bad names and might one day take a swing at him..." Incidentally, the case behind us - a young girl whose mother died in the last year is getting r***d by an uncle that shared the home with them. He threatens to kill her for calling the police and getting him arrested, and he's now out on bail. You be the lawyer now - what is the judge going to tell me about the name calling that you endured? You don't have a right to restrict someone else's freedom - so you don't have a right to a PPO. It is an option where the court is compelled through facts to intervene on behalf of an actual victim of stalking or violence. So, unless you can offer compelling evidence to support that stalking - you're not going to get a PPO - you are wasting the court's time and your money. The bar is high when restricting someones rights and when encouraging the courts to intervene. I am not saying that you are right or wrong about your need for a PPO - I'm just telling you what the environment is about when you attempt to do so. Other lawyers will disagree on some nuance, but think about what I'm telling you here if you decide to pursue a PPO.
