Custody isn't simply about dividing the calendar 50/50.

Colorado parenting arrangements involve more than counting overnight stays.

The circumstances of each family matter, including the children's needs and the ability of each parent to provide appropriate care.

If you're negotiating a parenting plan, make sure you understand what you're agreeing to and how it may affect your family.

Being a good dad matters. But understanding your legal rights matters too.

Many fathers assume that being actively involved in their children's lives will automatically protect their parenting time.

Custody decisions involve legal standards and the specific circumstances of each family.

If you're facing separation or a custody dispute in Colorado, take the time to understand how the law may apply to your situation.

Parents sometimes approach parenting time like a competition:

“Who gets more overnights?”

“Who gets more weekends?”

“Why should they get the same amount of time?”

But parenting plans are not simply about keeping score.

The practical questions are often more important:

Can the schedule work with the child's school?

Does it account for transportation?

Does it accommodate each parent's work schedule?

Does it address the child's developmental and individual needs?

Can both parents actually follow it?

And most importantly, does the arrangement serve the child's best interests?

Colorado courts deal with these issues based on the circumstances of each family. Recent appellate litigation has also reinforced that changes to parenting time can involve important legal distinctions depending on what the court is actually ordering.

The goal isn't to win the calendar. The goal is to create a parenting plan that works.

If you're struggling to create or modify a parenting plan

A protection order can affect much more than whether two people can communicate.

It may intersect with your home, children, parenting arrangements, and an ongoing divorce or parental-responsibilities case.

If you are subject to an order, seeking one, or trying to understand what happens next, do not rely on assumptions or advice from social media.

Understand exactly what the order says and what your legal options are.

Think a prenuptial agreement can guarantee you 50/50 parenting time if you ever divorce?

Not in Colorado.

A prenup can address certain financial matters, including property rights and spousal maintenance, subject to Colorado law.

But parents cannot use a prenup to predetermine custody or parenting-time arrangements. Those issues are determined based on the circumstances affecting the child.

That distinction matters.

You can plan for your financial future before marriage, but you cannot contract away the court's responsibility to consider the child's interests.

Planning for divorce does not mean expecting your marriage to fail. It means understanding your legal rights before you need them.

Considering a prenup or already married and wondering about a postnup?

Colorado family-law cases can involve competing schedules, relocation, safety concerns, missed parenting time, and changes in a child's needs.

And recent Colorado Supreme Court litigation has highlighted an important distinction between modifying parenting time and imposing a more serious restriction.

If your parenting arrangement is no longer working, don't wait until the conflict becomes a crisis.

Get legal guidance before making major changes on your own.

Divorce is rarely just about who gets the house.

A Colorado divorce can involve decisions about:

👉Marital and separate property
👉Debts and financial obligations
👉Spousal maintenance
👉Parenting responsibilities
👉Parenting time
👉Child support
👉Retirement and investment accounts
👉Future financial security

One of the biggest mistakes people make is focusing on the issue that feels most urgent instead of understanding the entire picture.

Before you agree to divide anything, understand what you are actually giving up.

If you are considering divorce in Colorado, getting informed early can make a significant difference.
