VICTORY ON APPEAL! A case against attorney Alex Pendl’s client was dismissed this week after the Court of Appeals issued a decision reversing the conviction. Mr. Pendl’s client was charged with OVI and a red light violation. At a suppression hearing, Mr. Pendl showed portions of the arresting officer’s cruiser camera and screenshots taken from the video proving that the traffic light was still yellow when his client entered the intersection. Mr. Pendl argued the traffic stop was unlawful. The trial judge denied Mr. Pendl’s motion, so Mr. Pendl appealed the decision. The Second District Court of Appeals issued a unanimous decision holding the traffic stop was unlawful and that all evidence obtained from the traffic stop was inadmissible. With all evidence being suppressed, the prosecutor was forced to dismiss the case.

FULL ACQUITTAL! Last week attorney Alex Pendl went to trial in the Darke County Common Pleas Court. Mr. Pendl’s client was charged with ten felony counts of Endangering Children, facing a potential maximum sentence of eighty to eighty-four years in prison. During the five-day trial, Mr. Pendl presented evidence that before the alleged victim went to the police, she had blackmailed his client and threatened to “ruin” him if he didn’t do what she wanted. Mr. Pendl also demonstrated how the forensic evidence did not match the alleged victim’s story. After almost two hours of deliberation, the jury returned a verdict of Not Guilty on all ten counts.

A Darke County jury returned a verdict of Not Guilty in favor of attorney Kevin J. Allen’s client today. Mr. Allen’s client was facing a Misdemeanor of the 4th Degree with a maximum penalty of thirty (30) days in jail and a fine of up to $250.00. After a half day jury trial this morning; the jury deliberated for an hour before reaching a verdict of Not Guilty on the original charge of Menacing.

NOT GUILTY ON AGGRAVATED ROBBERY!

A Darke County jury returned a verdict of Not Guilty in favor of attorney Alex Pendl’s client today. Mr. Pendl’s client was facing a Felony of the First Degree with a maximum penalty of Eleven (11) to Sixteen and a Half (16 ½) Years in prison. After a full day of trial yesterday, the jury returned this morning to hear closing arguments and deliberate. The jury deliberated for an hour and forty minutes before reaching a verdict of Not Guilty on both the original charge of Aggravated Robbery and the lesser-included offense of Robbery. Mr. Pendl’s client, who had been held in jail since being arrested almost three months ago, will go free today.
