After a work injury, most people assume they can just call their own doctor. In South Carolina workers’ comp, that’s not how it works and finding out too late can seriously hurt your claim.
Here’s what SC law actually says:
*Your employer controls the first choice. In South Carolina, your employer (or their insurance carrier) has the right to select your authorized treating physician. You generally cannot simply go to your own doctor and expect workers’ comp to cover it.
*You can request a change. If you have a legitimate reason — like feeling the authorized doctor isn’t addressing your injury properly — you can petition the SC Workers’ Compensation Commission for a change of physician.
*You have the right to a second opinion. Even within the system, you may be able to seek an independent medical evaluation, especially when it comes to your impairment rating at the end of your claim.
*Going outside the system has consequences. If you see an unauthorized doctor on your own, workers’ comp may refuse to pay for that treatment even if the care was legitimate and necessary.
This is one of the most frustrating parts of the workers’ comp system. The doctor your employer picks is paid by their insurance company and that’s a conflict of interest you shouldn’t have to navigate alone.
