After a work injury, most people assume they can just call their own doctor. In South Carolina workers’ comp, that’s not how it works and finding out too late can seriously hurt your claim.

Here’s what SC law actually says:
*Your employer controls the first choice. In South Carolina, your employer (or their insurance carrier) has the right to select your authorized treating physician. You generally cannot simply go to your own doctor and expect workers’ comp to cover it.
*You can request a change. If you have a legitimate reason — like feeling the authorized doctor isn’t addressing your injury properly — you can petition the SC Workers’ Compensation Commission for a change of physician.
*You have the right to a second opinion. Even within the system, you may be able to seek an independent medical evaluation, especially when it comes to your impairment rating at the end of your claim.
*Going outside the system has consequences. If you see an unauthorized doctor on your own, workers’ comp may refuse to pay for that treatment even if the care was legitimate and necessary.
This is one of the most frustrating parts of the workers’ comp system. The doctor your employer picks is paid by their insurance company and that’s a conflict of interest you shouldn’t have to navigate alone.

At the end of your workers’ comp claim, there may be one more thing you’re owed and a lot of people don’t even know to ask for it.

It’s called a Permanency award. Here’s how it works in plain language:

Once you reach MMI (Maximum Medical Improvement), your doctor assigns you an impairment rating - a percentage that reflects how much permanent loss you have to that body part.
That percentage is then applied to a set number of weeks assigned to each body part under South Carolina law. A back injury, for example, carries up to 300 weeks. A hand is 185 weeks.
Your weekly rate (2/3 of your average weekly wage) is multiplied by those weeks to produce your final award.
So if a doctor rates you at 10% impairment to your back, you’d be entitled to 10% of 300 weeks - that’s 30 weeks of pay as a permanency award.

It sounds simple, but the impairment rating your employer’s doctor gives you isn’t always the final word. A second opinion can make a significant difference in what you’re ultimately paid.

What you need to know:
How it’s calculated: You receive 2/3 of your average weekly wage, up to the state’s maximum. In South Carolina, that max changes annually.
When it starts: Benefits begin after you’ve missed more than 7 days of work. If you’re out longer than 14 days, you’re paid for those first 7 too.
When it stops: TTD checks end when your doctor says you’ve reached Maximum Medical Improvement (MMI) which means you’ve healed as much as you’re going to.
These checks aren’t charity, but they are a benefit you’re entitled to under South Carolina law. But navigating the paperwork, deadlines, and employer disputes alone is hard.

Workers’ comp in SC won’t pay for your pain and suffering and most people don’t know that until it’s too late.
