Many are celebrating the day after tax season, but many others are privately worrying whether the return they just filed will draw an audit. However, although the IRS will still audit, the reductions in IRS funding has particularly weakened its enforcement. Funding for enforcement was cut by $1.4 billion under the Fiscal Responsibility Act of 2023, by $20.2 billion under the Further Consolidated Appropriations Act, 2024 and by another $20.2 billion under the Full-Year Continuing Appropriations and Extensions Act, 2025. The result is an expected 50% cut to IRS enforcement personnel.

Federal audits may decline, but Pennsylvania audits are continuing in force. The Pennsylvania Department of Revenue consistently audits businesses, especially for business trust fund taxes like employer withholding and sales taxes. The Department’s enforcement has helped maintain strong collections this fiscal year, as March 2025 collections overall are only .1 percent below estimate and, notably, sales tax collections are .2 percent more than anticipated.

The Department of Revenue will research taxpayers’ websites, reporting history, business activities and industry to determine their exposure to sales and use tax, employer withholding, income tax, and other Pennsylvania taxes. Businesses that fail to pay sales tax and employer withholding tax can receive a visit from an enforcement agent threatening liens and even closure of the business. If you are faced with an audit, gather as much documentation as possible and seek the help of a tax professional to guide you through the process.
