A City of Asheville garbage truck struck and killed a 74-year-old pedestrian. The wrongful death lawsuit that followed runs into two legal doctrines most people have never heard of.
Contributory negligence, where NC victims can be barred from recovering if found even 1% at fault. And sovereign immunity, the rule that you can't sue the government unless it waives that protection.

This morning on Lawyer Up at 8:00am, Lisa will discuss several trending news stories including Lyndsay Clancy trial! Lisa cannot get enough of this trial and loves talking about it! She will break down the latest on trial of the 36-year-old mother accused of killing her three young children by strangling them with an exercise band. The case has captured national attention, and generated a lot of strong feelings.

Lisa will also talk about the controversy surrounding FLOCK cameras that read license plate plates, make/model and identifying features of vehicles, even though the motorists have done nothing wrong. The controversy involves the Fourth Amendment and whether creating a massive searchable national database violates privacy rights and requires a search warrant to utilize this information.

There is a crazy case Lisa will discuss involving biological parents who have sued a surrogate for over $100,000 in damages because the surrogate refused to have an abortion. The surrogacy contract had a fetal abnormality clause in which the biological parents could require an abortion. The surrogate mother moved to Texas and refused to have the abortion. She gave birth, but now the biological parents have custody of Baby Gabriel known as Rumi by the biological parents.

A New York City Park worker was arrested after a little 10 year old girl found an M-80 firework in a bathroom and brought it to the worker. He gave her a lighter, and when she detonated the fireworks, she lost all of her fingers.

The Christian metal band Demon Hunter is suing Netflix over their K-pop Demon Hunters show alleging trademark infringement and unfair competition.

A California woman lost over $300,000 to a fake Kenny Chesney scammer. But then she bought a lawsuit against the real Kenny Chesney. She lost at the trial court level then she appealed and lost again. Go Kenny! And there is a story involving a woman who spray painted a dead shrub green in order to avoid HOA fines.

Today on Jared & Katie In the Morning, Lisa will discuss two trending legal news stories. The first is the Penn State fraternity co***ne operation that was recently busted. And get this, a prominent Pittsburgh attorney is being charged along with the 13 students charged. He is the father of one of the accused ring leaders of the operation and is facing charges of felony evidence tampering and hindering an investigation. His son is accused of being one of the leaders of a large co***ne distribution operation in which the two students in charge of the operation would travel to New York and Philadelphia to purchase large quantities of co***ne then cut and package them for sale to students. These operations were carried out in their frat houses at Delta Upsilon and Sigma Chi. They even coerced pledges into helping cut and package the drugs.

Lisa will also discuss an Ohio trench collapse case that is making national news. It resulted in the death of one worker and serious injuries to several others. OSHA fined the company for failure to secure the trench and the workers told the employer it was not safe. The employer told the workers to go into the trench anyway, but now workers may be limited in their ability to sue.

A new investigation from NC Health News and WFAE lays out something families across North Carolina are living through right now. Nursing home abuse and neglect cases are harder to win than they should be.

Attorney Lisa Lanier breaks down two of the biggest obstacles, North Carolina's damages cap, and nursing homes leaning on COVID-era staffing excuses long after COVID stopped being the reason.

Yesterday we hosted 92 great folks from LLG at the North Carolina Zoo for Lanier Law Group Family Fun Day. Twice a year we come together with our LLG family from all over the state for food fun and fellowship. It was hotter than a firecracker but we still had a great time. Big thanks to the folks at Black Powder Smokehouse for catering a fabulous lunch. And special thanks to Janet Page for setting everything up and handing out the tickets. The super kind zoo employees made our visit extra special. I think almost everyone fed the giraffes and wow that was cool! The butterfly house was a big hit and of course seeing all the beautiful animals in the best zoo in the country was a great experience.
