Investing in the Next Generation. 🏛️⚖️

Had a wonderful time yesterday evening attending the Greencastle Elementary Career Fair. It was a privilege to represent the legal profession and speak with so many curious students about what it means to be a lawyer right here in our community.

Admittedly, the competition was stiff! It’s hard to make a legal case for paperwork and advocacy when the Fire Department and Sheriff’s Deputies are letting kids test out the sirens and explore their vehicles right outside. 🚒🚓

However, our firm’s station held its own—turns out, you can never go wrong with a stash of candy and some high-quality animal erasers! 🍬✏️

On a more serious note, we are passionate about the future of legal services in our rural areas. We need dedicated men and women who are willing to work, live, and advocate in small towns. If we inspired even one student to consider a future in the law last night, we consider it a win for the entire community.

Bieniek Law is proud to be part of the Emerald Palace rebuild at Robeann Park.

Community isn’t just about where you work. This week, Scott isn’t just behind a desk, he’s on site trading his suit for a tool belt. While Bieniek Law was honored to have donated equipment for the new structure, Scott felt it was important to get his hands dirty and contribute some manual labor to the build.

For Scott, this project is personal. The Emerald Palace has been an incredible asset for his own children over the years, providing a space for imagination, exercise, and friendship. He is deeply grateful for the opportunity to help ensure that the next generation of kids in our community gets to enjoy those same core memories in a safe, beautiful new space.

A huge thank you to all the organizers and volunteers making this happen! We can’t wait to see the finished palace and hear the sound of kids playing there once again.

This cautionary tale from the Court of Appeals of Indiana serves as a vital reminder that when it comes to growing your family, good intentions are no substitute for legal protection.

In the recent case of Olbera v. Sykes, the court had to untangle a complex situation involving a same-sex marriage and a biological father.

The Case at a Glance

A same-sex couple, Tiara and Nicole, wanted to have a child. They reached an agreement with a male friend, Demaj, who moved in with them. After several attempts, Nicole became pregnant by Demaj through consensual sexual in*******se.

Tiara and Nicole married shortly before the birth, believing the marriage would automatically make Tiara the legal parent. However, after the couple separated, a legal battle ensued between the spouse (Tiara) and the biological father (Demaj).

The Court's Ruling

The Court of Appeals ultimately ruled in favor of the biological father, reversing a previous trial court decision. Key takeaways from the ruling include:

In*******se vs. Artificial Insemination: Indiana law is clear—you cannot legally be a s***m donor if the child is conceived through in*******se. Legally, that makes you a father, not a donor.

The "Marital Presumption" is Rebuttable: While same-sex spouses are entitled to the same legal presumptions as opposite-sex spouses, those presumptions can be defeated by direct, clear, and convincing evidence—such as biological paternity in the absence of a valid donor agreement.

No Formal Agreement: Because there was no physician-led artificial insemination and no written agreement where the father voluntarily relinquished his rights, his parental status remained intact.

The Moral of the Story

If you are exploring alternative ways to conceive, consult with a family law attorney first. Simply having a friend come over to do the deed does not protect your parental rights or clarify the donor's lack thereof. Without the proper legal framework—including formal artificial insemination and ironclad contracts—you may find yourself in a years-long custody battle.

A few weeks ago, I reached out to each of our local school corporations with an offer to sponsor two teachers from each district to attend the Indiana Civics Summit & Educator Convening. I believe that empowering our educators with the best tools is the most effective way to inspire the next generation of informed citizens.

Cloverdale Middle School was the first to take me up on this offer.

While Principal Chelsey Meluch shared the wonderful news that the Indiana Bar Foundation is now covering the registration and transportation fees for the attending teacher, I didn’t want that to stop the momentum. I am honoring my original commitment by pivoting those funds into a direct donation to Cloverdale Middle School.

These funds will allow the attending teacher to bring the Summit’s lessons to life by purchasing new civics materials and resources for their classroom.

In today’s national and local political climate, understanding the foundations of our democracy has never been more vital. I am proud to support Cloverdale in leading the way!

Indiana is facing a critical attorney shortage, especially in our rural counties. As a member of the Board of Governors for the Indiana State Bar Association, I've been actively involved in developing a strategic plan to address this issue and increase the number of attorneys serving these underserved areas.

It was incredibly encouraging to recently host a bright high school freshman who expressed an interest in attending law school! It's conversations and connections like these that remind me of the importance of our work and the potential for the next generation to make a real difference. We need to inspire and support aspiring legal minds to consider careers in public service and rural practice.

I want to thank Judge Headley and Judge Bridges for allowing him to observe proceedings. And Prosecutor Austin Malayer for speaking to him at lunch.
