Q- I have not had a DUI in over 20 years butt I had a hearing and I was still denied my driving privileges what do I have to do to get in the BAIID program, I also have 3 DUI's in my background.

A- Simple Question but complicated answer. 1st. You have to understand the border of prof with the SOS. You must prove by clear and convincing evidence that you have resolved your (past) problem with alcohol/drugs. And, you must do so by "Clear and Convining Evidence". 2nd. That means that just because you have not had a DUI in 20 years that you'll get a D/L or RDP. 3rd. Do you have the following:
A. Current DUI Eval within 6 month
B. Treatment Plan
C. Treatment Verification
D. After Care Plan
E. Discharge Sumary
F. Continuing Care Status Report
G. Treatment Needs Assessement
H. Lifetime Drinking & Drug Use History
I. 3 Letters from AA members verifying your abstinence
J. 3 Character Letters
3rd. Even if you do have all of these items is the info consistint within those docs? If not, why not? If not, why hasn't it been addressed and corrected?
4th. Are you "ACTIVELY" engaged in AA? If not, why not?
5th Can you demonstrate your "knowledge of Recovery" Are you working the steps? Do you have a sponsor?
6th Do you have a Relapse Prevention Plan? If so, What is it?
7th Was your delivery of testimony at the hearing genuine and consistint with the info in the treatment docs and the facts?
8th Did you have counsel? Did he/she discuss ANY of the these issues with you?
9th Were your documents properly reviewed and consistint with all factual info?
10th Were you "prepped" by your counsel to understand the questions that would be asked of you BEFORE the hearing so you could answer the questions in the best possible light?
11th Did you acknowledge your past use and abuse of alcohol and of your alcoholism and OWN your actions and be accountable for your past?
If not, then no relief. No reinstatement and no RDP. Without an RDP you cannot participate in the BAIID Program. Only if your are granted permission to obtain an RDP are you allowed to participate in this program. I'd advise you to find a highly qualified Drivers Licebnse Reinstatement Attoorney who has handled many of these cases and have him/her review your denial, explain why you were denied and make a battle plan for your nest SOS hearing. GOOD LUCK !
