I wanted to address the issue of Artificial Intelligence and how it is impacting the practice of law. This includes attorney/client relationships as well as impact on the courts. We are seeing more and more clients who are using AI in order to question advice of lawyers and provide inaccurate input. This is blowing up into a larger problem.
First of all, the use of AI is a great tool. My firm has its own AI software that we use and we pay a lot for it. It is designed for lawyers. But even that kind of AI has its limitations.
What we are seeing is more and more clients and adverse parties trying to use their own free AI (chat GPT,, Grock, etc) to generate answers to their legal questions in order to counter our advice and knowledge of the law. Its almost like telling a doctor that he's doing his surgery wrong based on what AI is telling them. I am sure everyone understands how frustrating that would be if patients were using a free AI program to second guess what a doctor is telling them.
Another issue we are seeing are opposing parties who represent themselves and some incompetent lawyers using AI to generate court pleadings and motions. This is clogging up the courts with frivolous cases and difficulties. There is work in place to try to remedy this, especially in the Federal Courts. But, courts are always a step behind the tech.
Many firms are going to instruct clients regularly in the use of AI. Some things we wont do is us client generated AI in our pleadings and complaints. We are already seeing issues with AI generated contracts and estate documents. Many of these are full of problems and are increasing the risk of litigation. I currently have 6 cases in relation to estates that were screwed up by AI which is now resulting in disputes over estates, especially in the area of trusts. Over the last 2 years, our estate e litigation pracitice has increased by 600%.. AI generated documents has a lot to do with that. Clients dont alwats understand that free AI on the internet to do their legal documents is a bad idea and full of risks and costs. People like to avoid using lawyers because of the cost, but the cost of a messed up AI generated document can be 10's of thousands of dollars. Your family could be stuck with thousands of legal fees and years of heartache because of AI generated wills and trusts. And dont expect an attorney to simply look at and fix an AI generated document. The cost, time and risk involved in that is not somthing we want to undertake,
The moral of the story here is that use AI in complex matters at you own risks. Arguing with your lawyers about what AI is telling them vs. what the lawyer is advising them will result in them losing their lawyer. Also, dont try to represent yourself epecting that your AI generated pleadings are the best way to end run hiring a lawyer. That kind of decision court result in losing your case as well as massive court sanctions.
AI is actually going to be a huge tool in assisting clients. I am certainly not against AI. But remember that professionals purchase their own AI. We pay several thousand a month for it to assist us. Its 1,000 times better and more accurate than the AI available to the public.
