The No Kings Act is Senate Bill 747, authored by State Sen. Scott Wiener (D-San Francisco) and signed by Gov. Gavin Newsom on Tuesday, September 29. It creates a state-level cause of action letting people seek monetary damages from federal, state, or local officials for alleged constitutional violations occurring on or after March 1, 2025.
Why it matters legally: A federal law, 42 U.S.C. § 1983, allows people to sue state and local officials for constitutional violations, but no equivalent federal law existed for suing federal officials. The new law is meant to fill that gap. Its retroactive date of March 1, 2025, was chosen to include anyone affected by federal agents in Los Angeles during last year's enforcement surge.
