Charged with Common Law Robbery, Conspiracy to Commit Common Law Robbery, and 2nd Deg. Kidnapping, Mr. McAllister chose to try his case to a jury of his peers and was found not guilty on all counts on 2/18/2021.

A couple of updates to everyone in case you have questions about your case or the case of a friend or family member in Wayne County:

1) District court is happening every day, but it is only for first appearances, bond hearings, plea hearings, and probable cause hearings, all for people in the jail.
2) Superior Court is happening every Monday for jail matters that have to be pre-scheduled with the assigned ADA in advance.
3) The Department of Adult Corrections (NC prison system) will not be taking anyone from any county jails for at least 2 weeks starting today. That means that, even if there is a plea hearing in Superior Court, the defendant will not be heading to prison until that policy ends.
4) All other cases where defendants are not in jail are being continued out past 6/1/20 at this time. Even dates set past then are subject to change. If you would like the easiest way to keep track of court dates, go to https://www3.nccourts.org/onlineservices/notifications/menu.sp where you can put in the county of your case and file number as directed and get automatic email and/or text updates when your court date changes.

Until then, I continue to work hard from home and in the office and am filing and delivering things to the courthouse every day. I wish you all a safe and healthy week.

Had a guy stop me at breakfast this morning. After confirming that I was a lawyer, he said he had seen me in the courthouse and that I was "the coolest lawyer in there," and that I carried myself with a lot of "swagger." Great way to start my morning.

I understand that opioid addiction in our country has become a serious epidemic. However, I cannot believe that the precepts of fundamental fairness would allow a judge to bargain with offenders, who have no bargaining power whatsoever, to give up his or her reproductive rights in exchange for a commuted sentence.
