We had a good day at Mankey Law Office today. We were able to vacate a 2016 domestic assault conviction based on a manifest injustice. That client was in removal proceedings and was on his way to be deported. We argued that his plea was not knowing, voluntary, or intelligent. (that's the standard), because he should have been afforded a public defender or given time to obtain private counsel and that there was no Padilla warning in the Rule 15 petition. His immigration attorney tells us that the path to citizenship is now free and clear.

We are thrilled that we obtained a "credit for time served" disposition for an individual who has illegally re-entered the United States 5 times. The defendant has a wife and three American children and kept coming back to be with his family. The United States Sentencing Guidelines called for a sentence of 57-71 months but we were able to convince the Court that the 6 months he had spent in local confinement was sufficient punishment and that he should just be deported.
