The Richards Law Office practices immigration, criminal, and appellate law. We will also give counsel and represent attorneys who are facing bar complaints or discipline. The Attorney is admitted to practice in all Colorado courts, the District Court for the District of Colorado, and the Tenth Circuit and is in good standing with each. In our immigration practice, we focus on family-based, victim-

based, and employment-based immigration. We will accept removal defense cases on a case-by-case basis. Our criminal defense practice includes arraignments, motions, plea, trial work, and sentencing for misdemeanor charges and some felony charges. The Appellate practice will include both appeals of our trial cases and of the trial cases of others who determined it would be best for the client to outsource the appellate work. We will work either directly with the client or as appellate counsel, or of-counsel to trial counsel. We specialize in appellate procedure, brief drafting, oral argument preparation, and oral argument ex*****on. The goal of the practice is to honestly and with integrity represent all of our clients to the best of our abilities.

An Evacuation Order has been issued by Montrose County for the following neighborhoods, roads and trails:

All Bostwick Park residents are under evacuations.
Highway 347 is closed immediately, beginning at the Highway 50 intersection.
K73 Trail is under evacuation.

Firefighters are pulling back to perform structure protection as fire behavior is increasing. Aircraft will remain on scene for retardant and water delivery. Additional information will be provided as conditions change.

My power crush, Rabia, has some very good advice that we should all follow tomorrow.

1) really weigh the risks against the benefits of going to a rally if you aren't a citizen.
2) whether you're a citizen or not, maybe wear a mask. Leave your phone at home or turn off location and biometric data. Tell a trusted person where you will be and when you'll be home. Give them instructions on where to look for you if you're not home at the designated time.
3) ignore agitators. They will be there, and only to disrupt our protected speech. Don't let them.
4) be respectful of law enforcement. There is no reason to let a demonstration devolve. I understand the argument that rioting is a statement that the property system kept many people out for hundreds of years and so we havr the duty to work outside of the system... blah blah blah. No. Sorry. We're not doing that. And, anyway, here in Glenwood, there's no Capitol to storm. So we just shouldn't go there.

Ok, listen to Queen Rabia, check out the ACLU guidance on to-do's for rallies, and stay away if you are undocumented.

As we all know, Immigration and Customs Enforcement has ramped up its activity throughout the country over the past week. Every client and community member I've spoken to about this has wanted to know what their chances are of being sought out by ICE and arrested. It depends on your individual history and the places that you go to regularly.

One place that ICE cannot arrest people or get information from is out local school district. In May 2024, the Roaring Fork School District adopted the Safe Haven Policy, which prioritizes the safety, security, and mental well-being of our students. Children should feel comfortable while at school so that they can be focused and as successful as possible.

Our school district's policy is to ensure that schools are "sensitive locations," where ICE officials can only make arrests with a valid, judge-signed warrant. If a judicial immigration warrant is executed on District property, it must be done in a discrete manner so that it affects as few people on school grounds as possible. This policy also requires the District to safeguard student records against disclosure to non-school officials for immigration purposes.

Today's installment of helpful information:

ICE knocks on your door and wants you to open up. Do you have to? Well, do they have a warrant?

First, ask to see a warrant. This warrant should be signed by a Judge and state SPECIFICALLY who ICE can arrest, or SPECIFICALLY the area that ICE can search.

Then, call 1-844-864-8341 and report this ICE activity, whether they have a warrant or not.

I have attached a flow chart in English and in Spanish of what to do if ICE comes to your home, how to identify a valid warrant, and what to do if ICE enters your home.

While I may not be accepting new cases, I do think that the information that is out there and available to counteract the increase in ICE activity and the lack of prosecutorial discretion should be shared far and wide. I will be doing my best to share a resource for immigrants who experience ICE activity or are afraid of experiencing ICE activity each day.

Today's installment is the Colorado Rapid Response Network ICE Activity Hotline. You can contact them at 1-844-864-8341. You can select Option 1 to report ICE activity that you are observing in that moment to help us track ICE activity and make sure that ICE activity is happening both pursuant to the laws they are required to follow and that they are focusing on what few priorities we know they have been given, such as people without immigration status and a criminal history.

Please visit their website and get acquainted with their organization. If you're looking for an organization to donate to for whatever reason, whether it's your tax bill, your birthday, or just because you have an extra $20 that you want to do good with, this is a great option.
