No estate planning is Bad Estate planning!! For example:Unmarried middle aged woman dies with 401k and life insurance. 401K has no named beneficiary and will pass to 83 year old mom, but only after probate.. Life insurance named deceased dad as beneficiary. Two probates: one to transfer the 401K and the other for deceased dad's interest in the life insurance. Yikes!!

Easy and effective estate planning is to deed real estate out to children on a Transfer on Death (TOD) basis. The conveyance is not effective unless the property is owned by grantor at time of death. Named grantees acquire no veto power or control over sale of the property, unlike the traditional Life estate

There is an urban legend that its now extremely diffiicult to file bankruptcy. Not so!!! A married couple with an income of 55K and up to 150K of equity in their homestead may file a chapter 7 Bky. in Wisconsin.
