🚨 Immigration Appeals Just Changed — In a Big Way

Beginning March 9, 2026, a new federal rule will fundamentally reshape how immigration appeals are handled before the Board of Immigration Appeals (BIA).

This is not just a deadline adjustment. It is a structural change to how appeals work.

Among the most significant shifts:

• The appeal deadline in most cases is now 10 days instead of 30
• Appeals will no longer move forward automatically
• If the Board does not vote to accept an appeal, it will be dismissed within 15 days
• Full review will occur only in cases the Board affirmatively selects

For years, appeals often remained pending for many months — sometimes over a year or more. Under this new system, many cases may be resolved within weeks.

On Friday, we had the opportunity to visit ASU Law to interview candidates for our upcoming summer internship at Marcus Law Firm.

We received strong interest in the position, with 23 applicants overall, and selected a small group for interviews. Every candidate we met with was impressive—thoughtful, prepared, and genuinely interested in immigration law and advocacy.

We’re grateful to ASU Law for cultivating such talented students and appreciate the time and effort each applicant put into the process. We’re currently continuing our internal discussions and look forward to welcoming a summer intern (or interns) soon.

Experiences like this are a great reminder of the strength of the next generation of attorneys and the importance of mentorship in our profession.

As of October 28, 2025, USCIS now requires all immigration filing fees to be paid electronically.
đź’ł Checks and money orders are no longer accepted unless USCIS grants a specific exemption.

If you’re filing from inside the U.S., you can pay:

Online through your USCIS account using a credit, debit, or prepaid card, or a U.S. bank account (ACH), or

By mail using Form G-1450 (for card payments) or Form G-1650 (for bank withdrawals).
