When I became a lawyer, it truly humbled me to realize just how much trust clients placed in my hands: to reunite them with loved ones, to line up employees for critical projects, and to defend clients from deportation. I am tremendously grateful to the U.S. Helsinki Commission for its essential and indispensable support of Ukraine, and it was an extraordinary honor to testify before the Commission at its hearing on Supporting Ukrainian Refugees.

Our immigration policies must rise to meet this historic moment with morality and modernity.

Unfortunately, the U.S. does not currently have a refugee program for Ukrainians outside of the United States, but Canada will be rolling out measures including Authorization for Emergency Travel for individuals fleeing Ukraine.

For purposes of U.S. immigration law, potential resettlement to Canada could impact an individual’s ability to seek asylum in the U.S., but would generally not pose bars to other immigration options such as family reunification.

“As part of the Government of Canada’s response to Russia’s full-scale invasion of Ukraine, Immigration, Refugees and Citizenship Canada (IRCC) is introducing new immigration streams for Ukrainians who want to come to Canada temporarily or permanently.

For Ukrainians who want to come to Canada temporarily, we will create a Canada-Ukraine Authorization for Emergency Travel, available for individuals fleeing Ukraine. There will be no limit to the number of Ukrainians who can apply. This is the fastest, safest, and most efficient way for Ukrainians to come to Canada and eliminates many of the normal visa requirements. All Ukrainian nationals will be able to apply through this new path, and, pending background check and security screening, their stay in Canada could be extended by at least 2 years. We aim to have the extended pathway open for applications in 2 weeks, and, in the interim, we continue to encourage Ukrainians to apply through all programs, and their applications will be prioritized.”

Breaking news: Temporary Protected Status has just been designated for 18 months for citizens of Ukraine presently in the United States.

More information on eligibility and the process to follow in the forthcoming Federal Register.

“The Department of Homeland Security (DHS) announced the designation of Ukraine for Temporary Protected Status (TPS) for 18 months.

“Russia’s premeditated and unprovoked attack on Ukraine has resulted in an ongoing war, senseless violence, and Ukrainians forced to seek refuge in other countries,” said Secretary Alejandro N. Mayorkas. “In these extraordinary times, we will continue to offer our support and protection to Ukrainian nationals in the United States.”



Individuals eligible for TPS under this designation must have continuously resided in the United States since March 1, 2022.”

We’ve taken a little Facebook hiatus, but popping in to celebrate some good news this week. A very dear client received their physical green card—a plan B after being placed in proceedings long ago for a very old, youthful mistake. In the meanwhile this client earned a master’s degree, has helped support their beautiful US citizen family, and been a force for good in the community, improving educational opportunities for kids, advocating for justice, and now helping in efforts against covid spread.

Another great client just got their removal proceedings reopened, very narrowly avoiding deportation, to now get to fight to remain in safely here, and take care of their US citizen child, who had already been through so much, only to be further traumatized by the ICE arrest. Fortunately, the client is now released and reunited with family, and has a real chance.

Congratulations, President-Elect Joe Biden and Vice President-Elect Kamala Harris!

It has been an unrelenting, brutal, and depleting four years for folks in the immigration system, with unremitting attacks, suffering, and devastation unleashed on the immigrant community. So much of the already broken system has been gutted.

Today, we take a beat to breathe. Tomorrow, we roll up our sleeves and make sure that promises to restore integrity, humanity, and sense into the system are actualized and not forgotten.

The immigration community needs your voices and support to amplify this message. And we will continue to fight and advocate for our clients and for restoring justice and due process. 🗽

A legal complaint details how ICE officers forced some detainees to sign their own deportation orders.
