Today CNN projected Joe Biden as the president-elect. There apparently aren't enough uncounted ballots to make a significant difference to the Donald. Many Americans, with the exception of my brother Rick and about 74,000,000 others, will be disheartened. Regardless of for whom you cast your ballot, this is America. You voted and your vote counted. Now we all graciously accept the result and join ranks behind a new chief executive as we move forward in this 21st century, just as we did 4 years ago when many were disappointed. If you voted for Mr. Biden, you are elated. If not, then remember the old adage and "make lemonade." Please, let us end the divisiveness of the past 4 years and work together to make our country healthier, safer, more inclusive, and more prosperous. God bless America.

Although now 'semi-retired,' we continue to work from our home office and are limiting our practice to retirement division matters (QDROs). Please contact us any time you have a question about dividing a retirement plan (pension, 401(k), etc.).

Effective May 28th, JurDoc is no longer located at 610 North Gilbert Road. We have relocated our work space to our home office and now maintain 'virtual' office space at the Gilbert Heritage Building, 207 North Gilbert Road, Suite #001, Gilbert, AZ 85234. We remain available by telephone and email, but will meet by appointment only for mediation and legal document services.

This is the month we become 'semi-retired.' We plan to remain in business, but are shifting from our store-front office to a 'virtual office,' and will work from home. Sometimes settllement agreements & decrees in dissolution matters fail to include specific language that would enable the parties to divide IRAs without a separate, and expensive, Domestic Relations Order. Contact us and we will provide that language to you.

Many people are surprised to learn that Arizona is one of very few states that permits a 'beneficiary deed,' which avoids probate and allows the transfer of real property upon death without any value limitations (unlike an Affidavit for Transfer of Real Property). The deed must be recorded, but has no effect on title until the grantor's death, and can be revoked at any time.

Lately, here at JurDoc, LLC, we have been receiving lots of requests for QDROs, those "qualified domestic relations orders" necessary for an employer-sponsored, tax-sheltered retirement plan to transfer funds to the former spouse of a plan participant.

My lawyer clients tell me that we do them less expensively and more quickly than most of the busy retirement plan attorneys in Maricopa County.

When I was a newly admitted lawyer in 1977, I spent a good part of my first year "re-qualifying" and amending private retirement plans to conform to the (then) newly enacted Employee Retirement Income Security Act of 1974 (ERISA), a federal law that affects nearly all private retirement plans. I never foresaw how beneficial that early training in ERISA law and procedure would become, as QDROS weren't invented until the 80's.
