As a New Year kicks off, it is a good time to sit down and review your car insurance policy and limits. In particular, you should review your UM/UIM coverage (uninsured and underinsured motorist coverage). Many people do not know what UM/UIM coverage is and what their limits are until it is too late. UM/UIM covers your damages caused by bodily injury in an accident above the available insurance limits of the other driver. Unfortunately, we have seen too many times when one of our clients is involved in an accident and their medical bills and other damages far exceed the insurance limits of the driver who caused the accident. In that case, your UM/UIM coverage that you purchased steps in and will cover you up to the amount of the UM/UIM coverage under your auto policy.
The minimum limits of liability coverage under Kansas law are $25,000.00 per person and $50,000.00 per accident. Thus, if you are injured in an accident where the other driver is at fault, they are only required to have $25,000.00 of insurance coverage. If they do not have auto insurance, then you are only covered by your own UM/UIM coverage. Thus, it is vital that you self-insure against the negligence of other drivers and obtain appropriate UM/UIM coverage.
