Client's Concerns Regarding the Cost of Divorce

Many divorces are resolved relatively amicably and with minimal costs to the parties. Some divorces, however, are complicated by issues such as allegations of domestic violence, child custody and visitation, sophisticated financial holdings, allegations of hidden assets, allegations of assets being dissipated by a spouse, assets that one spouse may claim as his or her separate property, as well as other issues.

Clients frequently express concerns about the costs they will incur for legal fees and, if required in their particular case, expert witness fees, forensic accounting fees, evaluations and appraisals, attorneys for the children of the parties, etc. These concerns are particularly concerning if one party has limited financial resources or the other party has control over the parties assets.

If you are the disadvantaged spouse the New York State Domestic Relations Law permits you to make an application to the Court to require your spouse to pay all or part of your legal fees and other costs incurred in a divorce. If legal fees are your concern, you should consult with a qualified divorce lawyer here on Long Island to determine whether or not you may qualify to have your spouse pay for your legal fees.

Who the Broker Really Represents

Many times another question that I will be asked as a Long Island Real Estate Lawyer is, "Who exactly does the real estate broker represent?" In most cases, the real estate broker represents the seller so the buyer should be aware of this when dealing with the broker. The broker might not necessarily have their best interest in mind. Unless you enter into a specific buyer brokerage agreement with the broker that says on paper that the broker, in fact, represents you, they will represent the interests of the seller. I advise clients as a Long Island Real Estate Lawyer that you should be aware of that and be wary of any recommendations they might make. You should seek legal counsel before you sign anything provided to you by a broker.

Foreclosing on a Mechanic’s Lien

Foreclosing on a mechanics lien is very much like foreclosing on a mortgage to your house. Once a mechanics lien is placed on a piece of real property, it's just like a mortgage. If you don't get paid, you're like the bank. You can foreclose on the lien. You bring the owner into the litigation, you bring the general contractor who hired you, and you foreclose on that through a court process and litigate it just as if it were a mortgage foreclosure. The encumbrance on that piece of real property acts just like a mortgage. I advise clients as a Business Lawyer that the person who owns that property can't transfer his interest, he can't borrow money, he can't refinance, and he can't get any advances on loans if it's a commercial property and they're trying to expand and do additional renovations to the property. It's a very serious weapon. It is a very heavy leveraged item that trade contractors and other tradesmen out there use to get paid when there's trouble on the job.

As a real estate lawyer here on Long Island many times a question a client will ask whether or not they need title insurance. The answer is a resounding "yes."

What You Should Do If Injured in a Car Accident

As a car accident attorney here on Long Island, I am often asked about what you should do if you were injured in a car accident. If you've been hurt in a car accident, the first thing you should do is call the police. Even if it doesn't appear that there is a lot of property damage, injuries may still result as your body takes the force of the impact. Additionally, even if you're not hurt, the other party may claim injuries. It's always good to document it, have the police come to the scene and take statement. If you're feeling pain, you should go seek medical attention. Typically they will offer you an ambulance, which you should take to the hospital or seek medical attention soon thereafter. When you have a car accident, you are also required to report the accident to your insurance company if you are the owner a or to the person who owns the car that you might be a passenger in. As a car accident attorney I advise clients that medical benefits may be available; however, the claim must be established within 30 days of the accident so medical bills can be paid.
