Word to the wise: Never sell your real estate as an owner financer. And if you do, do not collect mortgage payments directly. Utilize a reputable mortgage servicing company from day 1. Credible accounting for mortgage lenders is absolutely essential. And, never sell real property in these situations before consulting with an attorney beforehand. A few dollars saved at the beginning can result in a lot of money spent to clean up a bad deal in a collections or foreclosure case.

It's never advisable to publish about your case, parties, children or witnesses on social media. It only invites more conflict. It also can jeopardize one's case. I cannot emphasize this strongly enough.

Justices of the peace in Houston and other metro areas adopted some activist policies in favor of giving tenants a chance to stay in their leases--motivated in large part by the housing crisis brought on during the pandemic. The Lege responded by toughening the laws in landlords' favor, while offering some olive branch to legit tenants. A concurrent problem has been squatters, which is a real problem. We'll see how the compassionate urban JPs apply and square these tough revisions to the programs designed to help keep the homeless population from swelling. There are problems on both sides of the landlord-tenant equation. Real property rights need to be protected from wannabe property rights (true squatters); but yet, when the economy, federal benefits, and social safety net is being dismantled from above, many tenants could also use a rehabilitative avenue.

CASE CLOSED: nonparent caregiver of children stepped in to get court orders to stabilize and care for children when a parent had abandoned them. Substantial investigation was conducted through my office in coordination with highly qualified private detective agency to bring the child safety risks to the court's attention. Temporary orders allowed the children to stabilize and be protected in the protective relative's care. Final orders rendered this week to keep the kids protected from the unstable parent. This case lasted several years and the children won.

CASE DISMISSED: Criminal charge of evading arrest dismissed due to identity theft/mistaken identity, where suspect gave the cops the wrong name (client's) then fled on foot and avoided capture. Cops charged client based on the real suspects identity theft. Police vest cam video showed that the real suspect had neck tats which client did not have. DA rightfully dismissed the charge against the innocent client. This case underlines how being simply charged with a crime doesn't mean the defendant is guilty. It also shows how useful police video can be in seeking truth and justice. And lastly, it shows a prosecutor doing the right thing. Prosecutors have a tough job and a heavy case load. In this case, I just helped the DA connect the dots.

CASE DISMISSED: Child custody case against my out of state client dismissed. After a contested hearing, the court declined jurisdiction in favor of my client's and the child's home state. When custody disputes cross state lines and a parent tries to forum shop in TX, ERL will investigate and apply the jurisdictional facts to shut down the shenanigans. A good day for my client, a good day for a child, is a good day for me.
