A traffic case is not always “just a ticket.”

One new Florida law taking effect July 1, 2026, changes the habitual traffic offender law by adding driving without a valid license to the list of offenses that may contribute to a habitual traffic offender designation when a person has the required number of qualifying convictions within a five-year period.

That designation can affect a person’s ability to drive legally and may create more serious consequences if they are later accused of driving while disqualified.

For many people, driving is tied to work, school, childcare, medical appointments, and daily life. Prior driving history matters, and the details of the charge matter too.

In Florida, eligibility to seal or expunge a criminal record is limited.

In most cases, a person may only seal or expunge one arrest record in one proceeding under Sections 943.059 and 943.0585, Florida Statutes. Applicants must also certify that they have not previously sealed or expunged another record in Florida.

There are limited situations where multiple arrests may be included in the same proceeding, but only if the court determines they are directly related.

In addition, a person generally cannot seal or expunge one record and later request relief for a different arrest in a separate proceeding.

Because the rules can be complex and depend on the specific circumstances, it is important to review eligibility carefully before beginning the process.
