What happens to an employment lawsuit if the claimant passes away?

Many people assume that employment lawsuits automatically end if the claimant passes away. However, that’s not the case. An appointed personal representative or close family member can step in to continue the claim on behalf of the estate.

The estate may still recover financial losses like unpaid wages or lost benefits that occurred before the claimant’s passing. With proper planning, any compensation can be passed on to the loved ones as part of the estate.

Everyone has an estate plan whether they realize it or not--every state has laws governing where your property goes when you die if you do not have a will or trust. These laws are designed around what states think an "ordinary" person would want. Are you "ordinary?" Unmarried couples, young children, relatives with special needs--these are people often overlooked in states' intestacy laws.
