What happens to an employment lawsuit if the claimant passes away?
Many people assume that employment lawsuits automatically end if the claimant passes away. However, that’s not the case. An appointed personal representative or close family member can step in to continue the claim on behalf of the estate.
The estate may still recover financial losses like unpaid wages or lost benefits that occurred before the claimant’s passing. With proper planning, any compensation can be passed on to the loved ones as part of the estate.
If you’re involved in an ongoing lawsuit or want to prepare for the unexpected, ensuring your legal and estate plans are in order is crucial.
