Being asked for your side is a reason to understand your position before responding.

An explanation intended to clear up a misunderstanding may become evidence. Statements from a voluntary police interview may be used in a criminal case—even when no arrest occurs and no Miranda warnings are given.

Those warnings generally apply to custodial interrogation, not every police conversation. A brief detention does not automatically qualify; the circumstances matter.

The answer is yes.

In Pennsylvania, a subpoenaed witness is entitled to the assistance of counsel—including while being questioned before an investigating grand jury. Counsel may be present and advise the witness, although counsel may not object, argue or address the grand jury or the attorney for the Commonwealth.

Being called as a witness does not necessarily mean you have been accused of a crime. It does mean that your testimony or records may become part of a criminal investigation.
