Some of the fog around CBD regulation may soon be lifted. Mitch McConnell just submitted a draft to the Senate Appropriations Subcommittee on Agriculture that, if adopted, would require the FDA to provide a report on its enforcement policy progress within 90 days and within 120 days, submit a policy of enforcement for products containing CBD falling within the definition of h**p that came with the 2018 Farm Bill. This mandate comes just over two months from the closing of the public comment period on the topic that followed the FDA public hearing on the regulation of cannabis products. It looks like this would be intended to be an interim policy guidance that remains effective while the FDA develops a more permanent regulatory framework, a process that former Director Scott Gottlieb once said could take years. This move by McConnell appears not unrelated to the financial industry's continued call for guidance that would allow investment in the CBD industry (legislation has been introduced fairly recently that addresses some of the uncertainty associated with the financing of CBD businesses). It will be interesting to see if the Subcommittee adopts McConnell's proposed language, and even more interesting to see what the FDA can come up with in six months if pressed!
