Once again, civil procedural defenses to the rescue.

Obtained a very (very) favorable result (dismissal) on an assault case where my client was already found guilty in the criminal arena!

In such situations, the only issues remaining in the civil arena are usually just how much money is to paid by defendant.

In this case, Plaintiff suffered severe and serious brain injuries claiming my client repeatedly punched him.

Unfortunately, Plaintiff was in the I.C.U. for 7 days as a result- totaling over $230,000.00 in only medical bills.

Plaintiff's story was covered by the media and was publicized due to its nature and graphics.

The Motion to Dismiss we filed was grounded on Code of Civil Procedure section 583.420 and California Rules of Court Rule 3.1340.

I would add that I believed my client (and so did many of his teachers) when he stated he was only defending himself in a fight plaintiff started.

My client was an honor student on the football team and wants to work in the medical field.
