Partner John M Frick recently received another rare "reverse and render" judgment on appeal. Representing a dentist accused of defaming a colleague in connection with the purchase of a dental practice, Mr. Frick appealed a judgment against his client for $240,000 damages for loss of reputation and mental anguish. Successfully arguing that the evidence did not support the damage award, Mr. Frick persuaded the court of appeals that the statements made did not actually tarnish the reputation of the plaintiff or cause her any compensable mental anguish. Boeke v. Collins, Case No. 05-22-01066-CV, Dallas Court of Appeals, (11-16-23).

President Biden appears poised to fulfill one of his campaign promises. The FTC is currently considering rules to ban noncompete agreements in most employment agreements.

Many employers rely on noncompetes to protect their trade secrets, proprietary customer information, or confidential business strategy. Others use noncompetes to preserve their workforce after investing time and money on valuable training.

As the FTC moves to eliminate noncompetes nationwide, employers may need to rethink their strategies to protect their valuable information and investment in their workforce.

The U.S. Federal Trade Commission, which enforces antitrust law, proposed a rule that would ban companies from requiring workers to sign noncompete provisions as well as some training repayment agreements, which companies use to keep workers from leaving for better jobs, the agency said on Thursday.

As this article states, it is common for the number of lawsuits against real estate professionals to increase in a cooling market. Unhappy home buyers and sellers often seek to cast blame on their real agents and brokers, and on the other party’s agent and broker, when their expectations are disappointed.

Our attorneys have experience defending real estate professionals who are wrongly blamed by buyers and sellers in litigation, in mediation, and in the complaint process before TREC. We also have experience pursuing litigation against such professionals when wrongful errors and omissions do harm the parties to a transaction.
