After input from FLEXCOM, SB235 was amended so that family law cases are exempt from new discovery rules was successful. The bill would exempt cases falling under the Family Code from new disclosures of:

** “The names, addresses, telephone numbers, and email addresses of all persons likely to have discoverable information, along with the subjects of that information, that the disclosing party may use to support its claims or defenses, or that is relevant to the subject matter of the action or the order on any motion made in that action, unless the use would be solely for impeachment.”
** “A copy, or a description by category and location, of all documents, electronically stored information, and tangible things that the disclosing party has in its possession, custody, or control and may use to support its claims or defenses, or that is relevant to the subject matter of the action or the order on any motion made in that action, unless the use would be solely for impeachment.”

These required categories would not fit well into family law litigation where claims develop or arise over time (think custody dispute after judgment is entered), whereas in general civil cases claims and defenses are usually known from the outset of the case.

Existing discovery laws and financial disclosure requirements will still apply in family law cases.
