ken the representation of clients in a class action law suit against Whirlpool Corporation in Clyde, Sandusky County, Ohio. For years, clients have been asking us to get involved because they could not get anyone to do anything. The lawyers and staff in our office waited, hoping that the families in Clyde would get results from state and federal agencies. To the dismay of our clients and the Clyde community, all they were getting was incomplete information and no answers. As a former Legislative Liaison for the Ohio Sierra Club (prior to law school) a former intern with the Ohio Environmental Council (following college), a founding member of the last Sierra Club Chapter in Toledo Ohio (created during law school), a former member of the Board of the Ohio Sierra Club and Ohio Environmental Council and now the President of the Christy Farm Nature Preserve I have seen, lived and worked in environmental law in Ohio for over 35 years. This issue in Clyde is an environmental catastrophe and demands the attention of everyone. In the 1980's it was Joe Albrechta that initiated the class action lawsuit against Sun Oil Company that evacuated thousands from their homes and businesses. When that suit (lasting 11 years) was filed, nearly all local, business and public officials criticized us and our clients for filing suit. We were even criticized from church pulpits and letters to the editor. They said there was no proof. But over 11 years we doggedly fought for our clients with the help and assistance of other area law firms. We eventually got to the truth. We found the cause--not without great cost and after many denials, uncovered truths and false claims being disproven. We settled the case and thousands of people in Sandusky County were finally and justly compensated for their loss. The Whirlpool case in now our challenge. Just like in past, our office and staff is dedicated to the rights of all of our clients. We will pursue the truth where ever it leads. We will find the answers. We do not pursue these matters alone. As in the past, we will be partnering with law firms having the expertise needed to fill out our legal responsibilities to our clients and the procedures of the Court. It is unfortunate that the search for the truth in the Clyde Cancer Cluster region cannot be done except in the Courts. Federal and state executive authority (Ohio EPA and U.S. EPA) do not give citizens the same rights and authority as they have in the Courts. In the eyes of the law, and under the auspices of the sitting judge, citizens have the same rights as multinational corporations. Citizens have the right to be heard, to get their questions answered, to secure hidden records and documents, to uncover the past and reveal truth. We seek ACCOUNTABILITY AND CLOSURE. We do this for our clients, for our community and for the sake of future generations. While doing this, we will continue to offer the high quality legal services to all of our client in our other areas of practice:

The Albrechta & Coble office gathered to bid farewell (for now) to Micaela Eberhard as she leaves to begin her course of study at The Ohio State University College of Law. Micaela joined us 2 years ago having graduated from Ohio University with a degree in Classics. She quickly excelled in her role as Assistant Office Administrator under the guidance of her mentor, Chief Office Administrator Kristy Witte. With that guidance and support she developed quickly in skill and knowledge in all departments of our office—Business Organizations and Transactions, planning and administration of Estate and Trusts, Personal Injury and Domestic Relations. Micaela’s quick study, great writing and organizational skills caused the professional staff to ask whether she ever considered law school. It was with great pleasure that we learned that she had taken the LSAT and applied to law school. She enters the school as a scholarship recipient and starts her next adventure in the world of the law this month. The office gathered to wish her well and to congratulate her as she starts on the path of a profession that she will excel in. The law will be a better place with Micaela becoming a lawyer. In plaintiff’s negligence action against defendants-restaurant and food supplier for injuries sustained from ingesting a bone found in “boneless” chicken wing, summary judgment in favor of defendants was not error since bone was natural to the dish consumed and not a foreign substance, plaintiff should have reasonably expected and guarded against the presence of a bone, and the fact that the large bone went undetected by plaintiff while he was cutting his food shows that it was likely undiscoverable by defendants.

THE ABOVE CASE WAS RECENTLY DECIDED. IT SHOCKS AND CONFOUNDS ME THAT JUDGES CAN REACH A CONCLUSION THAT "BONELESS WINGS" HAVE BONES AND THAT BECAUSE THE CONSUMER DIDN'T CUT INTO THE ERRANT BONE, THEN IT WAS OBVIOUS, THEY SAY, THAT THE FOOD SUPPLIER/MANUFACTURER WOULD NOT HAVE KNOWN IT WAS THERE. THAT IS NOT THE POINT. THE FOOD SUPPLIER/MANUFACTURER REPRESENTS NO BONES. THE PLAIN MEANING IS ENTITLED TO BE HONORED --NO BONES ABOUT IT!!!
