Pause on USCIS Decisions for Travel Ban Countries
On January 1, 2026, USCIS issued PM-602-0194, Hold and Review of USCIS Benefit Applications Filed by Aliens From Additional High-Risk Countries, which expands the adjudications pause of all immigration benefits requests for individuals subject to Presidential Proclamation 10998 of December 16, 2025, Restricting and Limiting the Entry of Foreign Nationals to Protect the Security of the United States (“PP 10998”).
The memo, effective immediately, instructs USCIS personnel to:
Place a hold on all pending benefit applications, subject to certain exceptions and regardless of entry date, for nationals of the countries listed in PP 10998, pending a comprehensive review;
Conduct a comprehensive review of all policies, procedures, and screening and vetting processes for benefits requests for nationals of countries listed in PP 10998; and
Conduct a comprehensive re-review of approved benefit requests for nationals of countries listed in PP 10998 that were approved on or after January 20, 2021.
Nationals of the following countries are subject to the adjudicative hold and comprehensive re-review of approved benefit requests (with countries added by PP 10998 in bold): Afghanistan, Angola, Antigua and Barbuda, Benin, Burkina Faso, Burma, Burundi, Chad, Côte d'Ivoire, Cuba, Dominica, Republic of the Congo, Equatorial Guinea, Eritrea, Gabon, the Gambia, Haiti, Iran, Laos, Libya, Malawi, Mali, Mauritania, Niger, Nigeria, Senegal, Sierra Leone, Somalia, South Sudan, Sudan, Syria, Tanzania, Togo, Tonga, Turkmenistan, Venezuela, Yemen, Zambia, and Zimbabwe. Individuals with Palestinian Authority-issued or -endorsed travel documents are also subject to the adjudicative hold and comprehensive re-review of approved benefits.5 Importantly, this includes those “... with a nationality, country of birth, or aliens who have acquired Citizenship by Investment (CBI) listed in PP 10998.”

DOS Announces Immigration Visa Processing Pause for 75 Countries
On January 14, the State Department announced starting January 21, 2026, it will stop immigration visa processing for applicants from 75 countries. Applicants will still be allowed to submit applications and attend scheduled interviews, but no new visas will be issued.

Weighted Selection Process for Cap-Subject H-1B Petitions will be effective on 2/27/26, in time for the FY 2027 registration season. The Weighted Selection Process will generally favor the allocation of cap-subject H-1B visas to higher-paid workers.

Prudential Visa Revocations new developments under Trump 2.0

INA section 221(i) provides the consular officer or the Secretary of State with discretionary authority to revoke a visa at any time, even after approval and when the visa holder is physically present in the United States. DOS will typically revoke a visa upon receipt of derogatory information (such as an arrest) without the need for a conviction. Per 22 CFR §41.122(c), consular posts should try to notify the visa holder of the revocation although it is not required. If DOS provides notice, the agency typically sends an email to the email address the applicant provided on the Form DS-160.
At the April 2018 Department of State liaison meeting, the agency confirmed that consulates have discretionary authority per 9 FAM 403.11-3(b) to revoke nonimmigrant visas for visa holders in the U.S. only following a DUI arrest. Visas that are revoked following an arrest for any offense other than DUI are handled by the Visa Office of Screening, Analysis and Coordination (CA/VO/SAC) at DOS headquarters. That office instructs the consulate that issued the visa to notify the nonimmigrant of the revocation.
The Department of State has also confirmed in an April 2015 Department of State liaison meeting that, if a visa holder is in the U.S. and his visa is revoked under INA 221(i), his stay, according to DOS, “does not impact that status,” and the revocation does not require immediate departure from the United States. Nevertheless, the revocation leaves the impacted individual with much uncertainty about their ability to obtain a future visa stamp, and in a perilous situation in continuing to extend their nonimmigrant status within the United States.
The DOS Liaison Committee has received numerous reports of prudential revocation of H-1B visa stamps by Mission India within the last few months, and this issue may have expanded to other consulates.

Hold and Review of Pending USCIS Adjustment of Status Applications Filed by Aliens Under the Diversity Immigrant Visa Program Purpose

Effective Dec 19, 2025, US Citizenship and Immigration Services (USCIS) to: 1. Place a hold all pending adjustment of status, ancillary benefits, and associated waiver applications, for aliens who are applying to adjust to lawful permanent resident status under the Diversity Immigrant Visa (DV) Program; and

2. Conduct a comprehensive review of all policies, procedures, and screening and vetting processes for adjustment of status, ancillary benefits, and associated waiver applications by aliens seeking adjustment of status under the DV Program.

USCIS New Photo Policy
Effective immediately, the new guidance in the USCIS Policy Manual limits the use of photos to those that were taken within three years of the date a person files a USCIS form. Additionally, self-submitted photos will no longer be accepted. Only photos taken by USCIS or other authorized entities will be used.

TRUMP CARD/GOLD CARD
USCIS posted a new form, I-140G, Immigrant Petition for the Gold Card Program. Before filling out Form I-140G, applicants must first register on trumpcard.gov and receive confirmation that their submission was accepted. The associated fee is $15,000 per person (principal beneficiary, spouse, child(ren), as applicable)

$100,000 Fee for New H-1B Workers
On September 19, 2025, the President issued a Proclamation that temporarily halts decisions on new H-1B petitions and bans entry of certain H-1B workers, unless a $100,000 fee is paid. The Proclamation took effect September 21, 2025, at 12:01 a.m. ET for twelve months (with the possibility of an extension).
Who is Not Affected?
• Individuals with an H-1B petition filed on their behalf before 12:01 a.m. ET on September 21, 2025.
• Individuals with a currently valid H-1B visa stamp.
• Individuals on whose behalf an H-1B petition was filed after 12:01 a.m. ET on September 21, 2025, requesting a change of status, amendment, or extension, and USCIS grants the change, amendment, or extension.
• Individuals who are granted an exception by DHS (may be granted only in “extraordinarily rare” circumstances).

Pause on All Decisions for Travel Ban Countries
On December 2, 2025, USCIS published PM-602-0192, Hold and Review of All Pending Asylum Applications and All USCIS Benefits Filed by Aliens from High-Risk Countries. The memo instructs personnel of the following for benefits pause, re-review, and re-interview where necessary.
It is important to note that the benefits pause, re-review and re-interview also affects foreign nationals who were born in any of the listed “high-risk countries,” regardless of whether these individuals hold a different nationality (i.e., passport from a different country) today.
The pause applies to adjudication of all form types, which includes adjudication for Form I-129, Form I-140, Form I-539, Form I-765, Form I-131, to name a few.

USCIS Policy Alert Shortens Maximum Validity Period of EADs for Many Categories s to enhance its screening and vetting efforts

The maximum validity period for initial and renewal EADs from 5 years to 18 months for those admitted as refugees, granted asylum, granted withholding of deportation or removal, for those with pending applications for asylum or withholding of removal, those with pending applications for adjustment of status under INA 245, and for those with pending applications for suspension of deportation or cancellation of removal.

Expanded Screening and Vetting for H-1B and Dependent H-4
Visa Applicants

As of December 15, the US Department of State will expand the requirement that an online presence review be conducted for all H-1B applicants and their dependents, in addition to the students and
exchange visitors already subject to this review. To facilitate this
vetting, all applicants for H-1B and their dependents (H-4), F, M,
and J nonimmigrant visas are instructed to adjust the privacy
settings on all of their social media profiles to “public.”
