Departamento de Seguridad Nacional, emiti贸 una suspensi贸n administrativa, impidiendo que el DHS otorgara la libertad condicional en el lugar (PIP) bajo el programa Keeping Families Together durante 14 d铆as. Sin embargo, a pesar de esta suspensi贸n, el USCIS seguir谩 aceptando presentaciones del Formulario I-131F, Solicitud de libertad condicional en el lugar para ciertos c贸nyuges no ciudadanos e hijastros de ciudadanos estadounidenses, y seguir谩 programando citas biom茅tricas para quienes hayan presentado la solicitud.

USCIS tambi茅n ha confirmado que solo puede solicitar un permiso de trabajo despu茅s de que se apruebe su Formulario I-131F. On August 26, 2024, the United States District Court for the Eastern District of Texas, in Texas v. Department of Homeland Security, issued an administrative stay, preventing DHS from granting parole in place (PIP) under the Keeping Families Together program for 14 days. However, despite this Stay, USCIS will continue to accept filings of Form I-131F, Application for Parole in Place for Certain Noncitizen Spouses and Stepchildren of U.S. Citizens, and continue to schedule biometric appointments for those who have applied.

USCIS has also confirmed that you can only apply for a work permit after your Form I-131F is approved. If you file your Form I-765, Application for Employment Authorization, before USCIS approves your Form I-131F request under this process, USCIS will reject or deny your Form I-765.

Regarding Biometric of "fingerprint" Appointments, all applicants with biometric appointments should continue to plan to appear at their appointment at the scheduled date, time, and place.
If applicants cannot attend the appointment, they can reschedule using USCIS's online rescheduling request process, as long as rescheduling takes place before the initial appointment expires.

Desde la semana pasada, Inmigraci贸n ha comenzado a aceptar solicitudes para el nuevo programa de parole (PIP) familiar. Aunque hay una demanda pendiente contra el programa, la orden del juez en ese caso permite que Inmigraci贸n siga aceptando nuevas solicitudes. Si cree que puede ser elegible para presentar una PIP, llame nuestro oficina.

Hoy, un juez federal de Texas acaba de dictaminar que el programa DACA es ilegal. Este fallo, aunque perturbador y legalmente incorrecto, no fue sorprendente, ya que el mismo juez, Andrew Hanen, dictamin贸 anteriormente que el memorando de Obama de 2012 que creaba DACA violaba la Ley de Procedimiento Administrativo. Biden intent贸 rectificar los problemas de la APA con el memorando de Obama formalizando DACA como una regulaci贸n, pero, para sorpresa de nadie, eso todav铆a no fue lo suficientemente bueno para Hanen, quien fue seleccionado espec铆ficamente por los AG republicanos para acabar con DACA. Como dictamin贸 Hanen hoy, el programa DACA de Biden "sufre los mismos impedimentos legales" que el programa original de Obama.

El 煤nico lado positivo de su fallo es que la administraci贸n Biden puede continuar procesando solicitudes de renovaci贸n, ya que el DHS legalmente no est谩 obligado a "tomar ninguna acci贸n de inmigraci贸n, deportaci贸n o penal contra ning煤n beneficiario, solicitante o cualquier otro individuo de DACA que de otro modo no lo har铆a". ser tomado." Today, a federal judge in Texas just ruled that the DACA Program is unlawful. This ruling, while upsetting and legally incorrect, was not surprising, since the same judge, Andrew Hanen, previously ruled that Obama's 2012 memo creating DACA violated the Administrative Procedure Act. Biden attempted to rectify the APA issues with the Obama memo by formalizing DACA as a regulation, but, to nobody's surprise, that still wasn't good enough for Hanen, who was specifically selected by Republican AGs to kill DACA. As Hanen ruled today, Biden's DACA program, "suffers from the same legal impediments" as the original program under Obama.

The one silver lining of his ruling is that the Biden administration can continue processing renewal applications, since DHS legally is not required to "take any immigration, deportation, or criminal action against any DACA recipient, applicant, or any other individual that would not otherwise be taken." I assume that Biden plans to appeal Hanen's ruling. How advance parole applications by DACA-recipients will be affected by this decision remains to be seen.
