Client pled guilty to a 2nd degree crime, applied to recovery court and was legally rejected by the prosecutors office because she “posed a danger to the community.” Court agreed and denied her recovery court appeal. We filed a motion to reconsider showing that this person is clean and sober , participated in rehab programs, opened up a business that employs dozens of workers, and is a shining example of someone who is not the same person that committed the underlying crime. A Christmas miracle happened today my friends and the judge reversed himself and ordered that my client be enrolled in the recovery court, saving her from a prison sentence. Persistence works. Client, who has always maintained his innocence, was facing 25 years to life in state prison for a 1st degree “Lundsford” Aggravated Sexual Assault charge. Thanks to our hard work and jury trial experience, he’s going home after 2 years and 4 months of pre-trial incarceration that the Court ordered despite the presumption of innocence.
