Listen up! This is the first of a series of Senate floor speeches given by Senator Sheldon Whitehouse. It traces the history of the rise of right-wing political movements since the early 1970's. So ... what does a "reasonable and Articulable suspicion under the totality of the circumstances" mean? Well, you have to judge this on an objective basis. Which means that you do not have to crawl into the head of the police officer's head to figure out what he/ she was thinking when they decided to stop you. I often describe this to my clients like this: Imagine you are floating around above the cop, and you see everything he sees, and you hear everything that he hears. If you would have come to the same conclusion as he did, then you have a "reasonable and articulate suspension under the totality of the circumstances." Under what circumstances may a police officer stop and detain you? In order for the police to stop and detain you, they must have a "reasonable and articulable suspision" under the "Totality of the cirumstances" to believe that a crime as been committed, or that eveidence of a crime is present.
