We spent part of Friday night with Joey Ruffalo ( and his lovely other half) at The Prosperity Lounge and WJBZ Praise 96.3 FM talking about Service of Process, the Debbie and Marie Domestic Violence Prevention Act, and our State of the Art Ankle Monitoring System, as well as BacTrack Alcohol Monitoring.. Thanks so much Joey for allowing us to talk about saving lives in the criminal courts and the function we serve in the Civil Courts. It was an amazing time and I hope we can do it again sometime!

We often get asked..
"WHY CAN'T I SERVE MY OWN DOCUMENTS?" I also get asked a lot if someone can accompany us..
Aside from the fact that its against the Rules of Civil Procedure ( which state over 18, and not a party- this means you or your sister or brother in law that could potentially be a witness) in most states.. even using a Professional Process Server, service has the potential to go sideways.. and it can for sure go sideways if tempers or emotions of those involved are present at the time of service.. just last week a person I served in a divorce proceeding pulled a weapon after I left on the filing spouse..

As someone that has done a great deal of disaster relief as well as chased down bad contractors.. LET ME JUST TELL YOU WITH DISASTER RELIEF MONIES COMING FROM INSURANCE/ THE STATE AND FEDERAL GOVERNMENT
All kinds of scam artists are going to pop up out of nowhere to offer their help cleaning up, doing demolition, and rebuilding.. I have attached a blog I wrote during the pandemic to help guide you through what is no doubt going to be a tough and difficult rebuilding process.
This blog IS NOT INTENDED ZS LEGAL ADVICE but simply a guide to help storm survivors not be victims again.

PROCESS SERVER MYTH: BEING SERVED IS BAD!!

BEING SERVED INFORMS YOU OF YOUR DUE PROCESS OF LAW & THAT YOU HAVE A MATTER BEFORE THE COURT. IT IS THE VERY THING THAT INFORMS YOU THAT YOU HAVE A MATTER IN THE JUDICIAL SYSTEM AND YOUR TIME FRAME TO RESPOND. SOMETIMES BEING SERVED IS A ALSO A FORMALITY TO INFORM YOU OF GOOD THINGS LIKE AN INHERITENCE YOU MAY OR MAY NOT KNOW ABOUT OR YOUR INTEREST IN SOMETHING THAT YOU MAY NOT OTHERWISE BE AWARE OF.

When I started Smoky Mountain Process And Legal Services years ago.. I never dreamed that it would ever be all that it has become. Certainly I didn't have on my bingo card that I would ever have the opportunity to present and teach others in the legal field about Service of Process.. I have had that honor and privilege twice this year.. 1st in July to the Smoky Mountain Paralegal Association.. and again on Sunday afternoon to 1st year Law Students at Lincoln Memorial University-Duncan School of Law Hybrid program learning about Rules of Civil Procedure.. My heart was racing as I made my entrance to my lecture by
" serving " Dean Lyon ( he was a great case study in being a perfect evasive defendant and allowed me to show the students a proper "drop service" lol) and beginning my lecture in what I can only describe as one of those "Someone pinch me, am I really here right now? How cool is this! " moments. I can only hope that the law students got something out of my lecture and can I just tell you what an amazing, bright and engaging class they were. ( One of them even knew when asked " What did I do incorrectly?", knew to answer " No SOP on Sundays allowed in Tennessee " ). What a privilege and opportunity to educate our future attorneys about the challenges of service that I was honored and humbled to have ! As Process Servers we say all of the time " If attorneys only knew" ... well it's my fervent hope that 50 future attorneys learned well and will remember that their school, and their Professor cared enough about them knowing to invite me to speak. Special thanks to Dean Lyon, the school and those great students for granting me a part of their education to do it, my sister - Beccs.. thanks for a fabulous power point, and of course my Candice for always believing in me and for always being my moral support, and finally for Chief Ken Swindle for setting an example of what being a good Process Server Investigator really means to an attorney.
