Lis Pendens, translated from Latin as “a suit pending,” is a notice of a lawsuit recorded at the registry of deeds against the title to property. It's similar to a lien, and can make the difference between winning and losing a real estate case. I use the lis pendens procedure in most of my real estate litigation cases like purchase and sale contract disputes, boundary line cases, and "quiet title" cases. Getting a lis pendens essentially puts a "hold" on a property, preventing the owner from selling, transferring or refinancing while the case slowly moves forward, creating the leverage needed to secure a favorable resolution.
