Tax season can be confusing for parties who are divorcing but not yet divorced. In a recent case, my client’s soon to be ex-wife filed her taxes separately and got thousands back, while my client would have to pay a considerable amount in if he is forced to file separately. By filing jointly they would have had owed nothing and more would be refunded.

This shouldn’t happen, but it does all the time. Neither side should file separately without an agreement from the other. We suggest calculating taxes both ways and determining which way produces the overall best results.
