A simple revocable living trust solves probate. But it doesn't solve estate tax, doesn't protect against creditors, doesn't manage means-tested benefits, doesn't move appreciation out of your estate. A properly built holding-company structure changes that: each property in its own LLC, all owned by a parent holding company, owned by your trust. A claim on the duplex stays at the duplex. Most states let title companies or escrow agents close real estate. South Carolina doesn't. The SC Supreme Court ruled back in 1987 that closing real estate is the practice of law — and only an attorney can do it. So you ARE getting a lawyer at closing. The question is: which one, and how well do they actually know you?
