After days of preparing, staying up late, ignoring family and friends, my law partner and I received a 6.7 million dollar verdict (included is statutory interest) today for First Christian Church of Tyler against Church Mutual Insurance Company. The award included 1.5 million for Church Mutual’s bad faith acts. This was one of the first cases, if not the first, that involved a cosmetic damage exclusion that was overcome by the insured at trial. Hopefully, next time they will think a little harder before not living up to their promises when taking a Church’s money for premiums.

I couldn’t be prouder of my law partner Vincent Circelli who took the lead and did everything except for the 1 witness I crossed. Vinny did an amazing job.

I also couldn’t be happier with our team. Andrew Spadoni, Sarah Arroyo and Amy Easley killed it. Stayed up really late every night and did anything to help us get the job done. Could not have done without them.

On May 5, 2023 (Cinco De Mayo), our law firm with MKim Legal were finishing a week long trial in Denver, Colorado against AmGuard Insurance Company.

At 3:45 p.m. the jury was released to deliberate. At 6:30 p.m., we received a unanimous verdict. $700,000 in general damages to make repairs, $880,000 for AmGuard's Bad Faith Breach of Contract, and $1,500,000 in punitive damages.

This was a hard fought and time consuming journey. I started preparing for trial on April 17, 2023. I worked every day for at least 15 hours a day, most days 20 hours a day to prepare. I poured my heart and soul into this trial. Most of my time was focused on destroying the insurance company's biased experts who couldn't help but stretch the truth. It took the work of not only me, but my entire team and MKim Legal to make this verdict a reality for our client, an immigrant from South Korea who came here to America to make a better life for himself and his family.

I was able to expose AmGuard's experts and highlight their deceptive practices including hiring an engineer to "support our cause of loss determination."

Most people don't know, but our law firm has won four trials since November of 2021. We've taken down State Farm twice, Aspen Specialty and now AmGuard. Needless to say, we are not afraid of trying a lawsuit.
