A lot of people are thinking Ma*****na has been rescheduled. It has not. Not yet anyway.
Here is the current status:
* The Process is Ongoing: The Executive Order acts as a directive to speed up the rulemaking process that began in 2024, but it is not a final, legally effective change in itself.
* Status of Rescheduling: The DEA and DOJ must still finalize the administrative record, and the change faces potential legal challenges before taking effect.
* What Schedule III Means: If finalized, ma*****na will move from a "Schedule I" (no accepted medical use) to "Schedule III" (moderate to low potential for dependence), grouping it with substances like ketamine and anabolic steroids.
* What It Does Not Mean: This is not federal legalization. Ma*****na will still be illegal at the federal level, and recreational use will not be authorized by this change.
* Major Impact: The primary, most concrete impact of moving to Schedule III is removing the 280E tax provision, which will allow legal cannabis businesses to deduct business expenses on their federal taxes, significantly increasing their profitability.
While the administration has indicated a desire to move quickly, final, legal rescheduling is pending in early 2026.
