What does juvenile dependency mean?

Juvenile dependency is a specialized area of the law. There is a juvenile dependency court and that's where the department of Children and Family Services bring legal actions against parents. And those actions allege abuse, neglect or abandonment of their children. If so, then they have a right to take the action to court, to see about protecting those children. Likewise, the parents have a right to have council and to defend against accusations made against them.

What are juvenile diversion and mediation programs?

Juvenile Diversion and Mediation programs are programs put in place to divert young people from the Juvenile Delinquency Court process. They are given certain requirements to complete. If they are successful of that completion, then their case is dismissed against them.

How does juvenile court differ from adult court?

Juvenile court differs from adult court in several respects. In juvenile court, you do not get a trial before a jury. The trial is before the judge alone. In juvenile court, if you are found to have committed an offense, you are committed as a delinquent. You are not given a criminal conviction for that particular crime. In juvenile court, juvenile records are for the most part confidential to everyone, so your case will not be able to be reviewed by a prospective employer in the future.

Can I access my child's juvenile records?

The short answer is yes. As a parent you have a right to access your child's juvenile records. You can make that request of the court, you can make that request of the clerk's office. And once they identify you as a parent of that child you should be granted access to your child's records completely.

What is a paternity test?

A paternity test in Florida is typically a DNA test. The kit will require that you have the inside of your mouth swabbed and then the child's mouth will be swabbed. And those swabs will be sent to a lab and they'll do DNA testing on the saliva and then they'll determine whether or not you can be excluded as the father or not.

What is an attorney ad litem?

An attorney ad litem is an attorney that's appointed by the court to represent the child. There's certain parameters as to when an attorney ad litem is to be appointed, if they are appointed then they will represent the child's interest. A guardian ad litem on the other hand represents a child's best interest, which may or may not coincide with the child's interest.

The father of my child will not admit paternity. What can I do in Florida?

If the father of your child, in Florida, does not admit paternity, you can file a petition to establish his paternity. You can have him served with the papers, he will have to meet the challenge in a court of law. There can be DNA testing that will establish his paternity, to a legal certainty. Then he will be required to pay you child support.

What are grounds for divorce in Florida?

Grounds for divorce in Florida are simply that one spouse has irreconcilable differences with another. Florida is a no fault state. You do not have to show fault in order to gain a dissolution of your marriage. You simply have to be able to prove, and that can be by sworn testimony, that you have irreconcilable differences in order to obtain that divorce.

Divorce is initiated in Florida in court, by the filing of a petition requesting dissolution of a person's marriage. That petition will be prepared generally by one of the parties, and then served by a process server on the other party and they go forward from there.

I've never admitted paternity but I want to see my child now. What can I do?

If you have not admitted paternity for that child, you can call up the mother and ask to see the child. However, in most cases, my guess will be that the mother will not accede to that request. If you want to be declared the father of that child, you will need to file a petition to establish your paternity, in a court of law.
