The deed signed over to your daughter last spring. The car retitled to your son. A tuition check for a grandkid. None of it looks like Medicaid planning. It looks like a family taking care of itself.

Medicaid's long-term care look-back reaches back 60 months from the day you apply, reviewing gifts, sales below fair value, joint owners added to a deed or account, and loans nobody paid back. Caseworkers check deeds, bank statements, and promissory notes, and generosity can look disqualifying later.

Spend-down is lawful too. It typically covers paying off debts, home repairs, or a prepaid funeral contract, though paying a relative for care generally needs a written, fair-value agreement.

Your brother says the estate's done. Then the title company in Tennessee calls. Says it isn't, not for the cabin.

That's the situs rule at work. Real estate follows the law of the state where it sits, not where your mom lived or where the will got probated. Nonresident decedent, out-of-state land. That means a second case has to open in that state before the deed can move. It calls for an authenticated copy of the will and the original probate order, and usually a local personal representative gets appointed just to handle that one piece of property.

Skip that step and the sale stalls at the closing table, months after everyone thought the file was closed.

Your cousin texts you mid-meeting: when's my check coming? You've got the letters, the filing's done with the court, and waiting still feels like stalling.

It isn't. Every state gives creditors a window to file a claim before an estate can close out. Some estates clear it in a few months, others take most of a year. Send money out before that window shuts, and a bill that surfaces late doesn't stay the estate's problem. It becomes yours, personally.

Partial payments are sometimes allowed while the estate stays open, but courts often want a refunding bond first, so nobody's left holding funds that went out too soon. Once the deadline passes, a late claim is generally barred for good.

The bank rep on the phone doesn't care that you're holding a signed will in your hand. She needs to see Letters Testamentary first. Not the will. Not your ID. That specific document, issued by the court.

The will names you executor, but naming isn't the same as authority. A probate court has to issue the actual document, and until it does, banks, insurers, and title companies have every reason to stay quiet about what your parent owned. In South Carolina and North Carolina, it's called Letters Testamentary when there's a will and Letters of Administration when there isn't. Maryland uses Letters of Administration either way, whether or not a will exists.

Hurricane season means bank branches close, roads flood, and the safe deposit box holding your parents' power of attorney sits behind a locked door nobody can reach.

A lot of families store the originals there because it feels secure. Fine, on a normal week. Not when the county calls for evacuation and the bank isn't open.

Advance healthcare directives travel well. Hospitals generally allow copies of a validly executed directive, and it's recognized even if you cross state lines to stay with relatives. Financial powers of attorney are stricter. A copy legally grants the same authority as the original, but banks and title companies often still request the original or a certified copy before they'll act on it.

The voicemail from the plan administrator was three sentences long. The retirement account pays whoever is named on the form. Not the will.

For one Fort Mill family, that form still listed a first husband, gone twenty years before the second marriage began. Beneficiary designations on retirement accounts, life insurance, and payable-on-death accounts control the payout, even when the will says something else. State law generally removes a former spouse's name from many of these accounts once a divorce is final. Employer retirement plans like a 401(k) are the exception, since federal rules can override that protection and let an old form outlast a second marriage and a second set of kids.
