Jurors should leave the courthouse knowing their service is over—not wondering whether they will become the next witness.

Jury duty is one of our most important civic responsibilities. We must protect jurors from unnecessary scrutiny after their service ends—or risk discouraging citizens from showing up at all.

At the same time, no defendant should be forced to run the gauntlet twice. Double jeopardy is not a technicality; it is a constitutional promise. And “manifest necessity” must mean truly necessary—not merely preferable. Without that high bar, the promise against double jeopardy becomes meaningless.

I was honored to join NewsNation today to discuss these issues in the context of the high-profile Lindsey Clancy case and the defense’s motion to dismiss on double-jeopardy grounds.
