Big changes took place last week regarding Florida negligence law. Previously Florida was a pure comparative negligence state where you would collect based on your percentage of negligence. Under the new law Plaintiffs collect nothing if they’re found more than 50% at fault in an accident. A motorist whose carelessness kills or injures a biker could argue that his failure to wear a helmet (not required in Florida) was more to blame. Many states have laws similar to this more than 50% fault law however, many of those states also have a mandatory bodily injury requirement for drivers whereas Florida still does not require drivers to purchase bodily injury coverage on their automobile. I tell my clients to make sure they purchase UM coverage so if they are in an accident where they are not at fault (bear in mind the new negligence laws with percentage of negligence) with someone that either has no insurance or does not have bodily injury coverage they can have a UM claim for injuries with their own insurance.
