Success takes Risk in any business. Minimize the fallout for the Risk and create a Plan B. Ask your self and your consultants, legal and otherwise, what could go wrong.

Are you doing business with out-of-state vendors, out-of-state customers, outside sales personnel...anyone out-of-state? Before you sign any agreement, ensure your agreement provides that the parties submit to personal jurisdiction and venue where you want it to be. If this simple boilerplate clause is missing or wrong, claims could be dismissed and the value of your contract lost!

Do you know the birthday and SS # for all individuals you do business with?

If you ever need to enforce your rights against non-military individuals you will need this to confirm non-military status because our troops have special protections from civil libility while they are in active service so they are not foreclosed upon or evicted from homes while they are abroad on duty without proper notice at their posts.

After a wave of foreclosures against our troops, judicial scrutiny is at an all time high. Judges will require increased detailed facts under oath confirming non-military status or a department of defense (DoD) certification. While, good for our troops, this could delay an eviction or foreclosure against non-military persons.
A DoD certification is simple and free ONLY IF you have the SS # and date of birth.

Include as space for DOB and SS # on all your agreements.
