The party who pays the owner’s title insurance policy premium in Florida varies by county.

Of the 67 counties in the state, 44 counties are seller-pay counties and 22 are buyer-pay counties. However, even in a traditional seller-pay or buyer-pay county, payment of the title insurance premium can always be negotiated between the parties.

Only a small percentage of your total closing costs are for title insurance protection. Your title insurance premium may actually amount to less than 1% of the purchase price and less than 10% of your total closing costs.

The premium for title insurance is paid only once, at closing; but the protection is “to the grave and beyond,” meaning it continues even after you or your heirs sell the property.
