FAVORABLE VERDICT ALERT ⚖️ 📄✍🚨 TBI TRUCKING - Liability Not Contested - Jacksonville, Duval County, Florida.
Congratulations to Trucking Parachute Trial Partner G. John Veith and Junior Partner Christine N. Gargano for obtaining a favorable verdict on a hotly disputed TBI claim wherein liability was not contested. The plaintiff alleged he sustained a permanent traumatic brain injury as a result of a head-on impact between a commercial dump truck and a loaded tractor trailer. Plaintiff claimed past and extensive future medical damages for alleged permanent neck, back and a traumatic brain injury. Plaintiff called his mother, father, brother and multiple experts. Plaintiff also sought $3 million for the loss future earning capacity, $5.5 million for pain and suffering, and a total ask of over $9 million dollars over his 47-year remaining life expectancy. Plaintiff’s brain specialist (well known in our circles) used a myriad of tactics (MR DTI, Neuroquant, WAVi/EEG testing, multiple neurological tests including oculomotor, vestibular, memory and cognitive testing). Plaintiff also called a neuroradiologist to testify that the DTI imaging and Neuroquant study confirmed the likelihood axonal shearing.
The defense strategy was simple - expose the scientific unreliability of DTI imaging and WAVi/EEG testing when used to diagnose TBI at the individual level. We are seeing more frivolous TBI claims that attempt to use similar types of imaging, testing and strategies. The jury returned a $599,000 verdict after four hours in this one-week trial, far less than the almost $10 million dollar ask.
