MSJ GRANTED ⚖️ 📄✍🚨 Legionella / Legionnaire’s Disease — $800,000 in medicals — respiratory failure, mechanical ventilation, prolonged hospitalization and rehabilitation — JUDGMENT FOR DEFENSE

Congratulations to Senior Associate Kariss Gainey of our Gainesville office for obtaining a full dismissal and summary judgment on a highly contentious Legionella case involving catastrophic injuries against a very large personal injury law firm that never came to the negotiating table and demanded all policy limits. The plaintiff had more than $800,000 in claimed medical expenses and alleged that he contracted Legionnaires’ disease after using a community spa in a condominium complex. Our client was the pool contractor and the claim was that negligent maintenance caused the Legionella exposure. Plaintiff subsequently experienced a prolonged hospitalization, respiratory failure, mechanical ventilation, rehabilitation, and persistent foot drop.

We retained a standard of care expert to develop a critical missing causal link defense between any alleged maintenance deficiency and Plaintiff’s illness. We also challenged causation and Plaintiff’s inability to establish sufficient evidence that the spa was the source of his infection. The Court agreed finding that Plaintiff did not have sufficient evidence connecting any alleged maintenance deficiency to his Legionella infection; and that Plaintiff’s causation theory improperly relied on a series of unsupported assumptions regarding the presence and source of the Legionella.
