For those of you that have property manager clients, please warn them of changes made to the EPA's lead paint rules earlier this year. Property managers must hire only a Lead-Safe Certified firm for building maintenance, repair, or painting activities that could disturb lead-based paint or face significant fines. We're finding that many are not aware of this rule change.

The EPA is conducting audits in SC and other states and I'm aware of at least one fine that has been issued to a property management firm in the Columbia market.

When you have a ratified contract to buy and sell residential real estate and the type of financing states "conventional," if the buyer later tries to send over an FHA Amendatory Clause, the seller should not be advised to sign it. This is a material change to the agreement and has extreme impacts on the seller, such as - most importantly - that an appraisal which comes back even one dollar shy of the sales price gives the buyer the option at her sole discretion to walk away...taking her earnest money with her. It gives 100% of the leverage to the buyer and removes the ability to sue for damages. In addition, common law contract modifications such as that would be require consideration for the seller to be giving up her rights under the agreement. This scenario should seek input from legal counsel before it ruins the deal.
