Not true.

A Section 1(b) Intent-to-Use application allows you to file before you’re selling, as long as you have a real intention to use the brand in commerce.

That can mean securing priority before launch, before marketing, and sometimes before someone else gets there first.

But filing early doesn’t mean filing casually.
There still needs to be a legitimate business intent behind the application.
