“If my child is hurt in an accident, I can just sign the settlement paperwork and take care of it, right?”
❌ Actually, in Mississippi, you can’t.
It surprises almost every parent we talk to, but under Mississippi law, a parent cannot legally bind their minor child to a personal injury settlement just by signing a release form.
Why the Law Steps In:
The legal system views minors (anyone under 21 in Mississippi when it comes to certain financial contracts) as lacking the legal capacity to sign away their rights. To protect children from having their financial futures signed away or the funds mismanaged, Mississippi requires a special safety check: Chancery Court Approval.
How the Process Works:
If your child is injured (whether in a car wreck, a dog bite incident, or a premises accident) and a settlement is reached, a separate legal process must take place before a single dime is paid out:
1️⃣ A Petition is Filed: A sworn petition is submitted to a Chancery Court judge (a Chancellor) detailing the accident, the child’s injuries, the medical clearance, and the proposed settlement amount.
2️⃣ The Judge Reviews It: The Chancellor’s job is to act as a protector for the child. They review the file to ensure the settlement is fair, the medical bills are properly accounted for, and the child has fully recovered or has future care accounted for.
3️⃣ The Money is Locked Away: Chancellors don’t just hand a settlement check to the parents to deposit into a general family account. The court will typically order the funds to be placed into a blocked, interest-bearing bank account that no one (not even the parents) can touch without a specific court order, or into a structured annuity, until the child reaches legal age.
The Takeaway: It adds an extra layer of paperwork and time, but it’s an incredibly important safeguard designed to ensure that if a child suffers an injury, the compensation they receive is fully preserved exclusively for their future.
