Summer Possession Notice Deadline for Possessory Conservators– April 15th

Planning ahead for summer possession is important for co-parents in Texas. Under the Texas Family Code, the managing conservator must give notice of their choices for weekend options with their child or children during the summer.

Texas Parents: Summer Possession Notice Deadline Is Approaching

If your custody order follows the Texas Standard Possession Order, an important deadline is coming up.

April 1st is the deadline for the non-custodial parent to provide written notice of their chosen extended summer possession dates.

Providing notice on time allows both parents to plan summer schedules, vacations, camps, and childcare in advance—and helps avoid unnecessary conflicts.

Be sure to follow all necessary steps in your order or divorce decree. You may be required to submit your notice in writing or other communication method including a parenting app, email, text or USPS mail.

Check the calendar and your child's school calendar to make sure everything lines up correctly.

If the notice isn't given by April 1st, the summer possession time may default to a set time or periods of time. Again, check your order or divorce decree.

Planning ahead makes for a smoother summer for everyone—especially the kids. ☀️

A common question the attorneys at Peace & Associates hear is about whether or not a 12-year-old child can choose where they want to live or which parent they want to live with in divorce or child custody modification cases.

It is common for parents, and children, to believe that once a child turns 12, they gain the legal right to choose the parent they live with and where they live. In reality, Texas law takes a more balanced approach. While a child’s voice can be heard, it does not control the outcome.
