A question I'm getting more and more: what happens to frozen embryos when a couple divorces?

More people are going through IVF than ever before. And a lot of them signed consent agreements at the fertility clinic without thinking about what would happen if the marriage ended. The answer right now is — it depends. Courts across the country are not on the same page. Some treat embryos as marital property subject to division. Others weigh the right of one spouse not to become a parent against their will. Illinois law on this is still developing.
